Welcome to Babylon! These Terms of Service ("Terms") govern your access to and use of the Babylon website, services, and platform (collectively, the "Platform") operated by Babylon (NIP: 9542895920, REGON: 542956470), registered in Poland ("Babylon", "we", "us", or "our").

By creating an account or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

1. Definitions

  • Platform: The Babylon (bbn.chat) subscription service that connects Idols and Admirers.
  • Idol: A creator who offers subscriptions and interacts with Admirers.
  • Admirer: A user who subscribes to an Idol to interact with them.
  • Subscription: A recurring monthly payment made by an Admirer to an Idol in exchange for access to chat.
  • Content: Any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Platform.
  • External Messengers: Third-party communication applications (e.g., Messenger, Telegram, Discord) used for chats between Idols and Admirers.

2. Eligibility

You must be at least 18 years of age to create an account and use the Platform. By using Babylon, you represent and warrant that you meet this age requirement.

3. The Babylon Service

Babylon is a platform that facilitates connections.

For Admirers:

  • You can subscribe to Idols for a monthly fee set by the Idol.
  • Upon a successful subscription, you gain the ability to interact with the Idol through an External Messenger linked by the Idol.
  • You can search for Idols using their social media handles (e.g., from TikTok, Instagram).

For Idols:

  • You can create a profile, set your monthly subscription price, and link your accounts on External Messengers to communicate with your subscribed Admirers.

IMPORTANT:

All chat interactions occur on External Messengers, not on the Babylon Platform. Babylon does not host, store, monitor, or have access to the content of these chats. Your use of External Messengers is subject to their respective terms of service and privacy policies. Babylon is not responsible for any content, conduct, or issues arising from these third-party services.

4. Account Management

  • You are responsible for safeguarding your account information and for all activities that occur under your account.
  • You must provide accurate and complete information during registration.
  • Idols are solely responsible for setting and managing their subscription prices.
  • Admirers are responsible for managing their subscriptions.

5. Payments, Subscriptions, and Cancellation

Payments:

All payments are processed securely through our third-party payment processor, Stripe. We do not store your full credit card information on our servers. By making a payment, you agree to Stripe's terms of service.

Subscriptions:

Subscriptions are billed on a monthly basis. They will automatically renew each month unless canceled.

Cancellation:

Admirers may cancel their subscription at any time through their account settings. The cancellation will take effect at the end of the current billing cycle. You will retain access to the Idol until the end of that period.

Other Payments:

The Platform may introduce features for one-time payments or tips in the future. These payments will also be processed through Stripe and will be subject to these Terms.

6. Refund Policy

All payments made on the Babylon Platform are final and non-refundable. Once a subscription or other payment is made, you receive immediate access to the service or content. Therefore, we do not offer refunds, prorated or otherwise, for any reason, including if you cancel your subscription or if your account is terminated.

7. Acceptable Use

You agree not to use the Platform to:

  • Engage in any illegal, fraudulent, or harmful activity.
  • Harass, abuse, threaten, or defame any person.
  • Distribute spam, unsolicited messages, or chain letters.
  • Impersonate any person or entity.
  • Violate the intellectual property rights of others.
  • Post or share content that is hateful, discriminatory, pornographic, or incites violence.

We reserve the right to suspend or terminate accounts that violate this policy without notice or refund.

8. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available" without any warranties. Babylon is a neutral facilitator and is not responsible for the conduct, content, or interactions between Idols and Admirers, either on the Platform or on External Messengers.

To the fullest extent permitted by law, Babylon shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Poland.

10. Changes to Terms

We may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Platform after any changes constitute your acceptance of the new Terms.
